Step-by-Step: What Happens When We Receive a Data Deletion Request under GDPR
When a user requests deletion of their personal data (“right to erasure”), this website will follow GDPR requirements to stay compliant. Here’s what happens:
1. Acknowledge Receipt of the Request
◦ Confirm receipt to the requester promptly, regardless of whether the request is received by email, form, or even verbally. Make a clear record of the date and details of the request.
2. Verify the Identity of the Requestor
◦ Ensure the person requesting deletion is the data subject (or properly authorized representative). Ask for reasonable proof of identity to prevent unauthorized deletion of another person’s data (e.g., confirm email address or ask for ID if necessary).
3. Assess the Request’s Validity
◦ Review whether the request meets the conditions for erasure. The right is not absolute: you must check whether any legal grounds require you to retain the data (such as fulfilling contracts, legal obligations, fraud prevention, or defending legal claims).
◦ If you have a legal reason to refuse, explain clearly to the requester why their data cannot be deleted.
4. Locate All Relevant Personal Data
◦ Identify all places where the requestor’s personal data is held (databases, backups, third parties, etc.) to ensure a thorough response. This may require consulting internal records or systems.
5. Erase the Data
◦ Permanently delete or anonymize all relevant personal data within your systems and, where appropriate, notify third parties or processors who also hold this data to delete it as well.
6. Inform the Requestor of Completion
◦ Notify the individual when their data has been erased and provide confirmation. If any data was not deleted due to legal exceptions, specify what was retained and why.
7. Document the Process
◦ Keep a record of the request, your actions, and your final response (including the reasons for any refusals). This helps you demonstrate compliance if audited by authorities.
8. Meet Timing Requirements
◦ All of the above must be completed within one month of receiving the request.
